“Negligence” means that a defendant failed to act as a reasonable person. There must be a causal link (proximate cause) between this failure to act reasonably and the injury you have suffered. That injury can present as physical or mental suffering. The injury may also include economic injury such as lost wages or lost earning capacity. The plaintiff must prove that the defendant’s actions are a product of negligence, the failure to use reasonable care. Personal injury cases may also include intentional conduct such as assault and battery, fraud, and defamation. A plaintiff may at times allege both negligent and intentional causes of action when plaintiff is not sure of the defendant's state of mind when the injury was caused.
